1. The lessee undertakes to use and govern the boat as if it were his property, according to the rules of the good navigator and with respect to the regulations of the Merchant Marine.
2. Only the person identified as the owner in the rental contract is authorized to govern the boat and he must return the boat in the place and on the date established by the lessor.
3. It is expressly prohibited:
   • Tow any boat or any object.
   • Participate in regattas, sports competitions and other events.
   • Governing the boat under the influence of alcohol, narcotics or any other type of narcotic substance or substance that diminishes or alters the capacity of the individual.
   • The transport of goods that violate the law or legal provisions in force in the Spanish state, or for illegal purposes.
   • Transport passengers in excess of the number authorized and indicated in the rental contract.
   • Sailing outside the authorized area, according to the classification of the vessel.
   • Tie the boat to a buoy that is not for public use.
   • Leaving the boat moored or anchored without anyone on board in roadstead, or unprotected waters.
4. It is the lessee’s obligation to stop and insure the boat as soon as possible when any of the warning lights that detect an anomaly in operation light up on the instrument panel, or when they perceive external signs that indicate a fault or malfunction of the boat. In this case, the lessee must contact the lessor and follow his instructions.
5. Damages of any kind that the lessor may suffer due to non-compliance with the conditions set forth in these articles and/or for use other than that agreed, authorize the lessor to withdraw the boat from the lessee and bill and collect from the latter the duly justified amounts corresponding to compensation for said damages.
6. The lessor may terminate the rental contract unilaterally and remove the boat from the lessee when he observes that the latter violates these articles.

1. The lessee agrees to pay the lessor:
   • The amount of the transfer and/or repair of the damages of the boat caused by the use of inadequate fuel.
   • The amount of the damages and/or thefts suffered totally or partially in the boat, as well as the transfer costs and compensation for the immobilization of the boat, estimated according to the number of days necessary for its repair and function of the corresponding invoice and calculating one day for every eight hours of work.
   • The amount requested by a third party as a redemption, regardless of the causes that have produced the need for said redemption.
   • The amount corresponding to the fines or penalties for any infraction of current and applicable legislation that the lessee may incur in the use of the vessel that is the object of the rental contract, as well as the corresponding surcharges for late payment by the lessee. and the judicial or extrajudicial expenses that it could cause.

1. The lessor delivers the boat in apparent good working order and in good interior and clean condition. It will be the lessee’s obligation to keep the leased vessel in good condition, as well as all the existing facilities in it.
   • It is the lessee’s obligation to check the condition of the leased boat and its accessories and verify the condition with the lessor.
   • The lessee is responsible for any loss or damage that occurs in the leased boat and the loss of any of its elements, as well as the delays caused by him in the delivery of the boat.
   • The boat will be returned with the complete safety equipment (vests, oars, fire extinguishers, etc.) which must have been checked by the lessee.
   • All accessories rented to the lessee will be returned in perfect condition. Otherwise, the lessor may use the lessee’s deposit to cover the costs of repairing or replacing them.

1. The rental rates include mandatory civil liability insurance, plus insurance for injury or death of the occupants.
2. These coverages are guaranteed and are assumed by the insurer with which the lessor has arranged the corresponding insurance policy, and are subject to what is agreed in the general or particular conditions of this, and to what is regulated by current legislation.
3. This policy does not cover damage, loss, or any other damage suffered in the belongings or personal objects transported on board the vessel, nor the damage suffered in said vessel due to theft, vandalism and/or accident of any nature.
4. The lessee, in the event that any member of his crew or he himself suffers an accident inside the boat, must notify the lessor, by formulating a written accident report, the causes, circumstances and consequence of what happened, as well as, if known, name, surnames and address of the cause of the act and of the witnesses and also the names and addresses of the injured parties, if any. Accident, for the purposes of this contract, will be understood as any fortuitous, spontaneous, external, violent event or event independent of the will of the person who suffers it and that occurs in any of the occupants of the boat.

1. In the event that the leased boat suffers a breakdown once the boat has been delivered, the lessee reserves the right to withhold the deposit within 48 hours to establish the reason for the breakdown by means of a technician.
2. Once the reason for the fault has been detected, two cases are distinguished:
   • When the breakdown occurs due to mechanical wear or for reasons not attributable to the lessee, the rental contract will be terminated and the lessor will return to the lessee the rental amount corresponding to the period of time that the latter has not been able to enjoy the boat due to the breakdown. . The fuel used during the period in which the boat has worked correctly will be the responsibility of the lessee.
   • When the breakdown occurs for reasons attributable to the lessee, the contract will be terminated and the lessee must pay the repair costs and the fuel consumed. In no case will the rental amount be refunded.
3. If on the same day of the rental, the leased boat suffers an unexpected breakdown before departure or an error is made in our reservation system, the lessor will return to the lessee the rental amount paid by the lessee. The lessor will not be able to claim any compensation for this reason.
4. In the event that the vessel has to be rescued due to an error, carelessness or negligence of the lessee and not due to a failure of the vessel, the lessee must take charge of the service offered (displacement for the relief of the vessel) for a value of €150.

The fuel consumed by the boat during its rental period is at the customer’s expense, except for boats whose rental price includes fuel.

The lessee must pay for the fuel at the current rates.

The tenant has the obligation to check that the deposit is full before his departure.

Reservations are made through www.seariders.es using a payment card. The client will have to make a payment of €30 for each rented vehicle or activity and the rest of the amount will be paid in our store on the day of the reservation.

It will be necessary to leave a security deposit in cash or by credit card. The amount of the deposit varies depending on the activity rented. Said amount will be reimbursed once the activity has been completed and the rented vehicle is in the same condition initially.

The client will be obliged to pay the lessor the amounts mentioned below, which the lessor has informed the client and are included in this contract:

– Billing in case of delay in the return of the vehicle.

– Costs and expenses derived from damage caused to the integrity of the vehicle.

– Payment of fines and expenses arising from its management.

– Costs and expenses derived from the replacement of the keys.

– The amounts of reservations canceled with a period of less than 7 days are not refundable. Date changes will be accepted at least 96 hours in advance. The cancellation of the reservation due to weather conditions will be the responsibility of the lessor and will always be for reasons of safety at sea. In this case, the lessor will return the entire reservation to the client.

– In the event that the lessee returns the boat before the scheduled delivery time, no payment will be made.

1. This contract shall be governed by and construed in accordance with the law of the country in which it was signed.
2. The questions that arise as a result of this contract between the lessor and the lessee are the competence of the Spanish courts and tribunals, to which both parties submit.

1. Jetski Center Premià de Mar SL through its website “www.seariders.es” requests certain personal data from the User. The data provided by the User will be incorporated into an automated file of personal data, owned by Jetski Center Premià de Mar SL, which will be processed in order to provide the services requested by the User. The User authorizes the automated processing of the personal data provided, necessary for the provision of the agreed services.
2. The personal information collected from registered customers is stored in a database owned by Jetski Center Premià de Mar SL, which assumes the technical, organizational and security measures that guarantee the confidentiality and integrity of the information in accordance with what is established in Organic Law 15/1999 of December 13, on the Protection of Personal Data, and other applicable legislation.
3. Jetski Center Premià de Mar SL, through its website, will use the data provided by the User internally to make the User aware of offers and promotions that it may consider of interest to the User.
4. Jetski Center Premià de Mar SL, through its website, will use cookies when the User browses the www.seariders.es website. Cookies are only associated with an anonymous User and their computer and do not provide references that allow the User’s name and surname to be deduced. Thanks to cookies, it is possible to recognize registered Users after they have registered for the first time, without having to register each time to access the areas and services reserved exclusively for them. The User has the option to prevent the generation of cookies, by selecting the corresponding option in their browser program.
5. Any registered user can at any time exercise the right to access, rectify and, where appropriate, cancel their personal data provided on the web www.seariders.es, by means of a communication addressed to Jetski Center Premià de Mar SL, made through sending an email to the address: cvilladk@gmail.com.
